Who can apply for a visa?

A person is eligible to apply for a visa if he or she:

  • Has an approved petition from the USCIS;
  • Is not subject to one of the grounds of inadmissibility found under section 212(a) and (b) of the Immigration and Nationality Act (INA); and
  • Meets all other requirements for admission into the United States, including those set forth by U.S. Customs and Border Protection at the time of travel.
